Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Automatyc (“Automatyc”, “we”, “our”, or “us”). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. The service
Automatyc is an AI receptionist and AI assistant software-as-a-service platform for small businesses. Features include answering inbound calls, booking and managing appointments, sending appointment reminders, requesting customer reviews, and (on qualifying plans) generating and publishing social media content on your behalf.
2. Accounts
You must provide accurate account information and keep it current. You are responsible for all activity on your account and for maintaining the confidentiality of your login credentials. You must be at least 18 years old and have the legal authority to bind your business to these Terms.
3. Acceptable use
You agree not to use Automatyc to:
- Violate any law or the rights of others
- Send unsolicited commercial messages (spam) or otherwise violate A2P 10DLC, TCPA, CAN-SPAM, or other messaging regulations
- Impersonate another person or business
- Harass, threaten, or defame anyone
- Publish content that is obscene, deceptive, or infringes intellectual property
- Attempt to reverse-engineer, probe, or disrupt the service
- Use the service to compete directly with Automatyc
You are solely responsible for all content your business sends or publishes through Automatyc, including automated voice, SMS, and social media content.
4. Subscriptions, fees, and billing
Automatyc offers recurring monthly subscriptions billed through Stripe. Subscription fees are charged in advance and are non-refundable except where required by law. Each plan includes a set monthly allotment of minutes; usage beyond the allotment is billed at the per-minute overage rate shown in your dashboard.
Prices may change. We will give you at least 30 days’ notice before any price increase takes effect. If you do not agree, you may cancel before the change takes effect.
You may cancel at any time. Cancellation takes effect at the end of the current billing period. There are no refunds for partial months.
5. Third-party services
Automatyc integrates with third-party services including Google (Calendar, Gemini, Business Profile), Microsoft (Outlook), Meta (Facebook, Instagram), TikTok, Telnyx, Stripe, Resend, and Kie.ai. Your use of those services is subject to their own terms. Automatyc is not responsible for outages, limitations, or policy changes by third-party providers.
6. Social media content
If you enable the Social Media Manager add-on, Automatyc generates content drafts using your brand information and publishes them only to accounts you have connected. Depending on the approval mode you select, you either approve each post individually, approve the weekly batch, or authorize auto-posting. You are responsible for all content published from your connected accounts, including content generated by Automatyc. By using the service, you authorize us to publish, on your behalf, content you have approved (or, if you select auto mode, content that meets your configured criteria).
7. Voice and SMS communications
You represent and warrant that you have all necessary consents and authorizations to use Automatyc to call and text your customers and prospects. You are solely responsible for compliance with the Telephone Consumer Protection Act, the CAN-SPAM Act, state-level consumer protection laws, the A2P 10DLC registration program, and any other applicable law. Automatyc enforces opt-out on its platform but does not provide legal advice.
8. Intellectual property
Automatyc and its logos, interface, and software are owned by Automatyc and protected by intellectual-property laws. You retain ownership of your business information, brand assets, and the content you upload. You grant Automatyc a worldwide, non-exclusive license to host, process, display, and publish your content solely to provide the service to you.
9. Termination
We may suspend or terminate your account if you violate these Terms, if your payment fails and is not cured, or if required by law. On termination, your access to the service ends and your data may be deleted after a 30-day grace period unless earlier deletion is requested.
10. Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Automatyc does not warrant that the service will be uninterrupted, error-free, or free of harmful components. AI-generated content may be inaccurate or inappropriate; you are responsible for reviewing it.
11. Limitation of liability
To the maximum extent permitted by law, in no event will Automatyc, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim arising out of or related to the service will not exceed the amount you paid Automatyc in the 12 months preceding the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless Automatyc from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the service, your content, or your violation of these Terms or any applicable law.
13. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email or in your dashboard at least 30 days before they take effect. Your continued use of the service after the effective date constitutes acceptance of the revised Terms.
